1. Acceptance of terms

By creating an account or using SurveyCrew.app, you accept these Terms of Use, our Privacy Policy, and Cookie Policy. You must be at least 13 years old to use this Service.

2. Account registration and security

• Provide accurate, current, and complete account information.
• Maintain the security of your password and account credentials.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized access or security breach.
• One person or entity per account; sharing accounts is prohibited.

3. Acceptable use

You agree NOT to:

• Upload illegal, fraudulent, defamatory, harassing, or harmful content.
• Violate any applicable laws or regulations.
• Infringe on intellectual property rights of others.
• Transmit viruses, malware, or malicious code.
• Attempt to bypass security measures, rate limits, or usage restrictions.
• Use automated bots, scrapers, or scripts to abuse the service.
• Impersonate others or provide false information.
• Interfere with other users' access to the Service.

4. Subscription plans and pricing

• Free Plan: 3 surveys, 1 team, 3 members, 250MB storage, 100 responses/month.
• Starter Plan: $25/month or $240/year - 25 surveys, 10 teams, 25 members, 2GB storage, 1,000 responses/month.
• Professional Plan: $65/month or $624/year - Unlimited surveys and teams, 100 members, 20GB storage, 10,000 responses/month.
• Enterprise Plan: Custom pricing with unlimited resources and dedicated support.

Prices are subject to change with 30 days' notice. Annual plans offer a 20% discount compared to monthly billing.

5. Billing and payments

• Payments are processed securely through Stripe.
• Subscriptions auto-renew unless cancelled before the renewal date.
• You authorize us to charge your payment method for recurring subscription fees.
• Failed payments may result in service suspension until payment is resolved.
• You are responsible for all taxes and fees associated with your subscription.
• All fees are non-refundable except as required by law or as stated in our refund policy.

6. Subscription cancellation and refunds

• You may cancel your subscription at any time through your account settings or by contacting support.
• Cancelling your subscription is different from deleting your account. When you cancel your subscription:
  • Your subscription will end at the conclusion of your current billing period.
  • Your account will remain active on the free plan.
  • Your data will be preserved (subject to free plan limits).
• No refunds are provided for partial months or unused time, except where required by law.
• If we terminate your account for violation of these terms, no refund will be issued.
• Annual subscriptions cancelled within 14 days of initial purchase may be eligible for a prorated refund at our discretion.
• If you delete your account during an active subscription, the subscription will be cancelled and no refund will be provided for the remaining time.

7. Usage limits and enforcement

• Each plan has specific limits on surveys, teams, members, storage, and responses.
• Exceeding limits may result in service interruption or upgrade requirements.
• We reserve the right to enforce fair-use policies to prevent abuse.
• Large file uploads, excessive API calls, or unusual activity may be throttled or blocked.

8. Content ownership and license

• You retain ownership of all content you create, upload, or submit (surveys, responses, media files).
• You grant us a worldwide, non-exclusive, royalty-free license to store, display, process, and back up your content solely to operate and improve the Service.
• You represent that you have all necessary rights to the content you upload.
• We may use aggregated, anonymized data for analytics and service improvements.

9. Intellectual property

SurveyCrew.app, including its design, code, logos, and trademarks, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without written permission.

10. Service availability

• We strive for high availability but do not guarantee uninterrupted access.
• The Service may be temporarily unavailable for maintenance, updates, or unforeseen issues.
• We are not liable for service interruptions, data loss, or downtime.
• We reserve the right to modify or discontinue features with reasonable notice.

11. Account deletion and termination

Voluntary account deletion:

• You may request account deletion at any time through your account settings.
• When you request deletion, your account will be scheduled for deletion 30 days from the request date.
• During the 30-day grace period:
  • Your account remains active and accessible.
  • You can cancel the deletion request at any time and continue using the service normally.
  • A deletion status banner will be displayed in your account settings showing the scheduled deletion date.
• After the 30-day grace period:
  • Your account and all associated data will be permanently deleted, including profile information, surveys, teams, responses, uploaded media, workspace settings, and subscription data.
  • Deletion is permanent and cannot be reversed.
  • If you own workspaces with other members, those workspaces will also be deleted.
  • Active subscriptions will be cancelled (no refund for remaining time).

Termination by us:

• We may suspend or terminate your account immediately for violations of these terms, illegal activity, or harm to the Service.
• If we terminate your account for violations, no refund will be provided and no grace period will apply.
• Upon termination, your access will cease immediately, and your data will be deleted per our retention policy.
• Sections related to ownership, disclaimers, limitation of liability, and dispute resolution survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless SurveyCrew.app and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of third-party rights.

15. Dispute resolution

• These terms are governed by the laws of the jurisdiction where our company is registered, without regard to conflict of law principles.
• Any disputes shall be resolved through binding arbitration or small claims court, rather than class action lawsuits.
• You waive the right to participate in class actions or representative proceedings.

16. Changes to terms

We reserve the right to modify these Terms of Use at any time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
